Colombia prohibits the import and sale of iPhone 12 and iPhone 13


A court in Bogotá, Colombia, has granted Ericsson a preliminary injunction against Apple that prevents the company, its subsidiaries and partners import, sell and even advertise certain iPhones and iPads with 5G connectivity within the country. To do this, Ericsson relies on several SEP patents related to 5G, patents that Apple accepts, but he thinks Ericsson is charging too much for them.

This preliminary court order means that sales of the iPhone 12 and 13, as well as iPads with 5G, are effectively stopped within Colombia, for which the judge also informed the local customs authority to block imports of those same products.

  The smartphone market is saturated: bad news for the iPhone

For now, even though Apple is appealing this lawsuit, the company must contact stores and social media platforms to stop selling and advertising iPhones and iPads that are already in stock. although for now it is not known if these products should be withdrawn from the country or not.

One of Apple’s arguments for this patent infringement is that Colombia does not currently have 5G networks available to consumers in the country, so an injunction on a patent cannot be enforced until a functional network exists.
